1. Introduction

Creators HQ ("we", "us", or "our") is operated by Hélvio Viveiros Nóbrega, a sole trader based in Portugal.

These Terms of Service ("Terms") govern your access to and use of the Creators HQ platform (the "Service").

By creating an account or subscribing to a paid plan, you agree to be bound by these Terms.

If you do not agree, you must not use the Service.

2. Description of Service

Creators HQ is a software platform designed to help content creators manage:

• Brands and agencies
• Deals and pipelines
• Production workflows
• Pricing structures
• Outreach tracking
• Business insights and analytics

The Service is provided as a digital subscription-based software solution.

We do not guarantee specific financial or business results.

3. Eligibility

You must be at least 18 years old to use the Service.

By using the Service, you confirm that:

• You have legal capacity to enter into this agreement
• You are using the Service in compliance with applicable laws

4. Account Registration

To use the Service, you must create an account.

You agree to:

• Provide accurate and complete information
• Keep your login credentials confidential
• Be responsible for all activity under your account

We are not liable for unauthorized access caused by your failure to protect your credentials.

5. Subscriptions & Payments

Creators HQ offers paid subscription plans.

By subscribing, you agree that:

• Subscription fees are billed in advance on a recurring basis
• Billing occurs monthly (unless otherwise specified)
• Payments are processed via third-party payment providers

If payment fails, we may suspend or restrict access to the Service.

You may cancel your subscription at any time.

Cancellation takes effect at the end of the current billing period.

6. Right of Withdrawal (EU Consumers)

If you are a consumer located in the European Union, you normally have a 14-day right of withdrawal for digital services purchased online.

However, by subscribing and requesting immediate access to the Service, you expressly agree to:

• Immediate performance of the Service, and
• Waive your 14-day right of withdrawal once access to the Service begins.

This consent is obtained during the subscription process.

7. Refund Policy

Except where required by applicable law, subscription payments are non-refundable.

8. User Responsibilities

You agree not to:

• Use the Service for illegal purposes
• Upload unlawful, misleading, or harmful content
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the platform

9. Intellectual Property

All rights, title, and interest in the Service, including software, design, and branding, belong to Creators HQ.

You retain ownership of the data you input into the platform.

We do not claim ownership of your business data.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available".

We make no warranties regarding:

• Uninterrupted availability
• Accuracy of analytics or insights
• Financial or business outcomes

11. Limitation of Liability

To the maximum extent permitted under Portuguese and EU law:

Creators HQ shall not be liable for:

• Indirect or consequential damages
• Loss of profits or revenue
• Data loss caused by user input errors
• Service interruptions

Our total liability shall not exceed the total amount paid by you in the previous 12 months.

12. Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in misuse of the Service

13. Governing Law

These Terms are governed by the laws of Portugal.

Any disputes shall be subject to the exclusive jurisdiction of Portuguese courts.
